Terms of Use
Effective July 20, 2026 · KlickTutor is in private testing; these terms are under legal review and may change.
1. Agreement
By creating an account or using KlickTutor (the "Service"), you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old and act in a professional capacity (for example, as a tutor or educator) to hold an account.
2. What the Service does
KlickTutor is a record-keeping tool for reading-intervention tutoring: rosters, lesson logs, skill and fluency tracking, assessment records, and reports, including read-only report links you may share with a parent or guardian.
KlickTutor is not a curriculum, not an assessment instrument, not a diagnostic tool, and not a substitute for professional judgment. It records the information you enter; it does not evaluate students or make educational decisions.
3. Your account
You are responsible for the accuracy of your account information, for keeping your password confidential, and for all activity under your account. Tell us promptly if you believe your account has been compromised.
Do not share your login. If another person needs access, they should have their own account.
4. Student information and consent — your responsibility
You decide what student information to enter. Before entering a student's information, you must have the legal authority and any parental or guardian consent required for you to collect, record, and share that information.
You are responsible for complying with the laws, regulations, and program requirements that apply to your practice — which may include laws governing children's personal information, student education records, and any scholarship or state-program rules you participate in.
You agree to enter only information that is reasonably necessary for tutoring purposes, to keep it accurate, and to honor parent and guardian requests to review, correct, or delete a record.
You are responsible for how you distribute parent report links. Share a link only with the family it concerns, and revoke it when it is no longer needed.
Do not enter sensitive information the Service is not designed to hold — for example medical records, disability determinations beyond what is necessary for reading instruction, government identification numbers, or payment card details.
5. Acceptable use
Do not use the Service to violate any law or another person's rights; to store unlawful, harassing, or abusive content; to attempt to access another tutor's data; to probe, scan, or disrupt the Service or its security; or to reverse engineer, copy, resell, or create a competing product from the Service.
We may suspend or terminate accounts that violate these terms or that put student information at risk.
6. Your data
As between you and KlickTutor, the records you enter are yours. We claim no ownership of your student records.
You grant us only the limited permission needed to host, process, back up, and display that content in order to provide the Service to you.
You may export your records to CSV or print them at any time, and you may request deletion of your account and its records.
7. Availability and private testing
The Service is currently in private testing. Features may change, and the Service may be unavailable at times for maintenance or updates.
We take backups, but you remain responsible for keeping your own copies of records you cannot afford to lose. Export regularly if a record matters to you.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost, and we make no representation that using the Service will produce any particular educational outcome or satisfy any legal or program requirement applicable to you.
9. Limitation of liability
To the fullest extent permitted by law, KlickTutor and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of your use of the Service.
To the fullest extent permitted by law, total liability arising out of or relating to the Service will not exceed the greater of the amounts you paid for the Service in the twelve months before the claim, or one hundred U.S. dollars (US$100).
10. Indemnity
You agree to indemnify and hold harmless KlickTutor and its operator from claims and costs arising out of your use of the Service, the information you enter, your sharing of report links, or your breach of these terms — including any claim that you lacked the necessary consent or authority to record a student's information.
11. Termination
You may stop using the Service and request deletion of your account at any time. We may suspend or terminate access if these terms are violated or if required to protect the Service or the people whose information it holds.
12. Changes
We may update these terms; we will revise the effective date above and notify tutors of material changes through the Service. Continued use after changes take effect constitutes acceptance.
13. Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and the state and federal courts located in Florida will have exclusive jurisdiction over any dispute.
